BEMIDJI — After a recent inspection of a Ridgeway Court apartment, 10 families have been given notice to vacate the building due to unsafe living conditions.
The Bemidji City Council heard a report from Rental Inspector Ben Hein during its Monday, May 16 meeting about the Ridgeway Apartments located at 2830 Ridgeway Ave. NW and its deteriorating and unsafe conditions.
Those who live in a Ridgeway Court apartment at 2830 Ridgeway Ave. NW has been ordered to evacuate on June 13 by the city of Bemidji due to its deteriorating and unsafe conditions.
“The steady decline at 2830 has reached a breaking point,” Hein said. “Although the property owners have made some progress in repairing the building, the deterioration has dramatically outpaced the repairs.”

A recent inspection of the building, owned by NETA Property Management of Fargo, N.D., found broken windows, discarded pins in the hallway, holes in walls and doors that could not be locked or secured, among other violations.
All of these problems led Hein to continue revoking the building’s rental license and posting notices demanding that management vacate the 10 families living in the building within 30 days.
“I understand this is a big step and some people will be inconvenienced during this process,” Hein said, “but as a community we have to help each other and make sure everyone has a safe place to live.”
Four of the families living in the building have already received help in arranging other housing situations, and six remain who still need help with housing.

As part of the reporting process, residents who were asked to leave were given resources they can contact for help, including the Beltrami County Health and Human Services office.
“I think we’re going to see a rally of support around these families, I have no doubt about it,” said Ward 2 Councilman Josh Peterson.
The Ridgeway apartments have had other problems in the past, and residents from the buildings have brought those concerns to the city and filed management and safety complaints in the past.

After Hein gave the council his report, Mayor Jorge Prince shared a letter he had received from a resident who lived in one of the apartments.
“The building I live in has boards instead of glass on the doors … the windows of the apartment are completely broken out,” Prince read. “It goes on and on. I’m starting to fear for my family, but I don’t feel like we should be the ones who have to go. Help please.”

When action was finally taken on the apartment’s situation, members of the council acknowledged the difficulty of such a decision.
“This has been a long process,” said Ward 4 Councilwoman Emelie Rivera. “This was absolutely the last option we wanted.”
But now that it has been taken, the council expressed hope that the community would come together to support the affected families and help them transition to new homes.
“These are good people trying to make a good living,” said Grand Councilor Daniel Jourdain. “This community stands together on issues like this. It shows how strong Bemidji is.”

BEMIDJI — After a resident of the Ridgeway Court II Apartments in Bemidji filed a tenant emergency action alleging the complex was not kept in reasonable repair, a 9th District Judge has ordered the property’s landlords to increase security.
According to court documents, the court order, issued April 7, requires landlords NETA Property Management Inc., Reed Sabbe and Judith Triebwasser, all of whom are based in Fargo, to install a steel door at the building’s north entrance along with an alarm or surveillance system to improve the building’s security.

“We are pleased that the court issued an emergency order for the landlord to improve security,” said Reed Olson, executive director of the Nameless Coalition for the Homeless, who testified on behalf of the tenants.
This comes after several cases of illegal access to the complex which led to the installation of security cameras.
These, according to the defendants, were then spray painted over and individuals tried to get into the building in other ways, including by breaking in through windows.
“This case highlights the problem of absentee landlords failing to meet their legal obligations to maintain the facilities and safety of their tenants,” Olson said.

Initial legal action was taken by a tenant on February 16, who cited concerns that the complex was not being kept in reasonable repair. Those concerns included not being able to heat the apartment to maintain 60 to 65 degrees Fahrenheit without opening an oven door.
The tenant testified that the loss of heat in the apartment affected their medical condition and that the need to use the furnace to heat the residence posed risks to themselves and their grandchildren who live with them.
Additional concerns were that windows and doors were not kept in reasonable repair, making the building unsafe, and that the apartment’s laundry facilities were not kept in a usable condition.
An attorney for the landlords certified on February 25 that the problems had been resolved, but after the problems persisted, the resident filed an emergency tenant action seeking a court order to require the landlords to address those problems.

According to court documents, Ninth Judicial District Judge Jeanine R. Brand heard the case and ruled that the heating and safety problems were enough to be considered emergencies, and issued a court order for them to be fixed.
At this hearing, testimony was heard from Sabbe about the measures taken and from Olson who spoke about the property’s conditions.
When the negotiation ended, Brand found that the problems with heating were solved but that the safety problems continued.
This led to another court order requiring the landlords to install a steel mortise door at the north entrance and install an alarm and/or other monitoring system that will notify management if a door breach occurs so it can be quickly addressed, documents said.
