A University’s Partnership Reshapes Bowling Green, Ky.

Plans for a parking garage and commercial wrap on Block 6 of the downtown Bowling Green Tax Increment Financing District have been controversial for years. Those plans changed and adapted and eventually turned into roadblocks in the form of closed restaurants and liens on the property.

A week ago, nearly $2.4 million in liens were filed against Mills Family Realty Inc. for unpaid money for construction services for the commercial wrap. Restaurants run by the company’s founders in the wrap — 6-4-3 Sports Bar and Maria’s — also closed Monday.

Clinton Mills of Mills Family Realty said in an email to the Daily News regarding the liens: “We are working diligently toward a resolution. There are a lot of moving parts and hopefully this will be resolved in the near future.

Negotiations over the troubled Hitzens Park Plaza continue, with Warren County and Bowling Green officials working to get another group to take over management of the development.

County Attorney Amy Milliken said Friday that Judge-Executive Mike Buchanan and Warren County Downtown Economic Development Authority Chairman Doug Gorman will meet today with Bowling Green Hot Rods owner Jerry Katzoff to discuss the issue.

Milliken said legal action against Mills Family Realty is being considered, but not necessary.

“I think legal action is necessary if we can’t reach an agreement because I have to get liens off the building … It’s a requirement to pay the contractors or they won’t remove the liens.”

On Feb. 27, Milliken Mills sent Family Realty a notice that its lease agreement with the county was in default.

The letter lists five instances of default and gives the business 30 days to resolve those issues.

Those issues include non-receipt of premium lease revenue by January 15, breach of lease terms and conditions and payments from the project fund, subleases not being in required form and not collecting rent for closed square footage. Restaurants, the project fund is not in proper balance and liens are placed on the property.

Doug Gorman, chairman of the Warren County Downtown Economic Development Authority, said water was removed from the parking garage and wrap after snow and freezing temperatures caused flooding after heavy rain two weeks ago.

The parking garage was part of the TIF district’s original plans, which received final approval from the state in October 2007.

But two years later those plans changed. In October 2009, the Bowling Green City Commission and the Warren County Fiscal Court approved a change in the TIF district plan allowing a developer to build a 100-room hotel nearby.

Land for a downtown parking garage had already been purchased and the buildings demolished at the time of the switch. Developers have backed away from downtown development, citing the deteriorating economy as making development unaffordable.

In February 2010, a 370-space gravel parking lot and water retention basin were under development near the Bowling Green ballpark to replace the parking garage.

But officials are still pursuing a parking garage at the site, and members of the Warren County Downtown Economic Development Authority are actively seeking developers for Block 6 and other TIF blocks.

“We’re not just sitting around waiting for someone to show up. We’d love to have someone tomorrow if we could, but that’s not very realistic,” Mary Cohran, the authority’s then-president, said at the time.

In May 2011, the authority approved moving forward with a request for proposals for construction management services for Block 6, where an 821-car parking garage and multi-use shell were planned. Originally, the garage was intended to be the first phase of a wrap developed with about 80,000 square feet of space facing College Street.

Kevin Brooks, the authority’s attorney, said at the time the authority was approaching the project as if it were the developer, but was also pursuing private developers for the project.

As of December 2011, work on the parking garage at Block 6 is underway and the second phase is set to enter construction by the end of the year.

The estimated $9 million garage will serve as a parking structure for downtown visitors to places like Bowling Green Ballpark and the Southern Kentucky Performing Arts Center, which has yet to open.

“It was a tremendous impact,” Gorman said at the time. “It’s going to alleviate some of the (parking) issues with SKyPAC and the ballpark.”

In March 2012, financing was initiated for the commercial wrap of the Block 6 parking garage.

That month, the fiscal court approved an ordinance that issued $22 million in industrial revenue bonds for the development, with the idea that the county would not back the bonds.

In March 2012 the Bowling Green City Commission passed a municipal order expressing the Commission’s intent to lease the parking garage with lease payments equal to the bond payments on the commercial wrap.

The municipal ordinance was approved by a 4-1 vote, with Commissioner Bill Waltrip voting against the measure, citing risk to the city behind his vote.

“The city is still guaranteeing the bond payment, and I don’t want that to happen,” he said at the time.

But Commissioner Melinda Hill supported the project, comparing the city’s involvement to that of an entrepreneur.
