1 Antiquities on Padre Island The island has a long, rich history that stretches back to the first Native Americans on the Gulf Coast about 5,000 years ago. They were followed by the Spanish, who explored the area for nearly three centuries, and finally by Anglo-American colonists. After 2 generations of effort, on June 8, 1906, President Theodore Roosevelt signed the Antiquities Act, establishing the first general legal protection of cultural and natural resources in the United States. The Act set important precedents, including expressing public interest in archeology on public lands, as well as supporting the care and management of archaeological sites, collections, and information. The act linked the protection of sites and their associated scientific excavations with public programs to provide for the maintenance and public interpretation of the artifact collections and information on the study site and its contents.

3 The Act arose out of concerns that arose during the last quarter of the 19th century about the preservation of America’s archaeological sites and the artifacts and information they contain. National and regional educators and scientists, including those involved in the development of archaeology, have united in a movement to protect public land sites that are threatened by haphazard digging and deliberate, commercial looting of artifacts.

4 The Antiquities Act was the first law to recognize archaeological sites on public lands as important public resources. It requires federal agencies that manage public lands to preserve the historic, scientific, memorial, and cultural values ​​of archaeological and historic sites and structures on those lands for present and future generations. It also authorizes the president to protect landmarks, structures, and objects of historical or scientific interest by designating them as national monuments.

9 Protecting Antiquities Because removing an artifact from a national park deprives the public of a piece of American history, metal detecting and artifact removal are prohibited in all national parks, including Padre Island National Seashore. If you find an artifact, please report it to the Malaquite Visitor Center information desk and let us know where you found it so the park can conduct a proper archaeological dig and learn more about the island’s history. In return, you’ll receive an official National Park Service certificate commemorating your efforts and contributions.
