The initial allegations sent to the CMRAO involved complaints by two different condominium companies about record transfers, transfers of funds, competence, and responsiveness.

An agreed statement of facts in the CMRAO proceedings was entered into as a compromise to avoid lengthy hearings. The complaints in both case files relate to situations that were scheduled for January 2020.

At both hearings, the disciplinary panel heard a number of submissions from CMRAO’s counsel, who advised that CMRAO drop all allegations of failing to comply with its section 8 financial responsibility in providing administrative services. The CMRAO has also waived all allegations under section 11 relating to any act or omission that may be considered dishonorable, dishonorable, and unbecoming of the licensee. The CMRAO also waived any unsuccessful claims, under section 13 to promote and protect the best interests of the licensees’ customers.

The CMRAO, by entering into agreed statements of fact and withdrawing significant allegations, considers these matters to be minor and is satisfied that it has taken appropriate steps to ensure that the public is protected.

Regarding the Notice of Suspicion, we do not object to an audit that we will voluntarily submit to. However, publishing a suspension is clearly punitive, disproportionate, and unreasonable. The suggestion that the integrity of the organization, members, and the entire ACMO Certification program will be challenged or will be challenged if allegations of violations are not published publicly, respectfully, were unreasonable and appear to be unfairly directed to impact our business.
