Royal Bay Villas and more than two dozen other condo and home owner associations are suing American Property Management and its Wells Fargo bank, court records show.

The suit alleges Americans Property Management refused to turn over Wells Fargo bank statements to show what was happening with the association’s money.
Jason Hamilton Mikes, the attorney who filed the lawsuit, says tens of millions of dollars are unaccounted for.
“Now we’re operating like in emergency mode, so to be betrayed like that and just to know that they lied to us and basically took all our money and ran away, and it affects lives, it affects other associations. it affects the lives of families,” Rigsby said.
“We reached out to Wells Fargo for comment and a spokesperson said they could not offer comment due to pending litigation.” The last statewide eviction protections for low-income California renters affected by COVID-19 ended Thursday, but many still haven’t heard back about their requests for rent relief. On Thursday, eviction protections expired for thousands of California households still waiting in line for payments from the state’s billion-dollar rent relief program.
As of September 2020, the Legislature passed and Governor Gavin Newsom signed four bills protecting tenants who were unable to pay rent due to COVID-19 from eviction. The most recent extension protected tenants until June 30 who applied for rent relief from the state’s $5 billion program by the March 31 deadline but have yet to hear back or receive payments. These tenants can now be taken to court by their landlords.
“It’s highly unlikely that they will get through all of these applications by June 30, when the eviction protection expires,” said Sarah Treuhaft, vice president of research at PolicyLink, a nonprofit that reviews the state’s rent relief program. press conference this week. “That means they’re likely to be evicted and eventually could get rental assistance.”

Debra Carlton, chief lobbyist for the California Apartment Association, said they have asked their members not to take their tenants with pending applications to court.
The state Department of Housing and Community Development, which administers the program through a contractor, announced on July 1 that it had approved all complete applications for eligible tenants. Geoffrey Ross, deputy director managing the program, said they were still processing 13,000 applications that either lacked documentation or were appeals from denials. They expect to clear all pending applications by early August.
The rent relief program paid an average of $11,000 to 339,000 households for a total of nearly $4 billion, according to the state’s public data panel. Inspections will soon be on their way to about 16,000 homes approved this week.
The gap between completed and approved applications has narrowed significantly over the past week as case management has accelerated. On June 30, the program panel showed that about 404,000 people had completed their applications. Late this morning, after this story was originally published, the dashboard was updated to show only 352,000 completed applications. Ross said more than 70,000 applicants were removed from the queue and rejected due to account inactivity. Those applicants with incomplete applications were contacted at least three times and given at least 20 days to respond, many times longer, he said.

Based on data as of June 23, PolicyLink, which reviewed weekly program data from the state through Public Records Act requests, found more than 28,000 original applicants and 57,000 people who reapplied had not yet heard from the program. Ross, of the housing department, said the data, although produced by the state, had “errors in interpretation” but declined to comment on the details.
Horne LLP, a Mississippi-based accounting firm that specializes in disaster relief, will be paid a maximum of $278 million to distribute federal rent relief funds capped at $4.5 billion, according to an April 1 contract renewal , which was obtained through the Public Records Act on June 17. The housing department was unable to say how much the company has paid to date.
State Assemblywoman Buffy Wicks, an Oakland Democrat who co-authored the latest expansion, acknowledged the program was “incredibly frustrating.” She said the Department of Housing had assured her legitimate claims would be paid.
“I think it’s no secret that it’s had problems,” she said. “And while I’m sympathetic to some of the challenges we’ve had as a state government in dealing with a global pandemic that none of us anticipated, it’s also our job as a government to do well, especially when you’re talking about critical social safety nets.”

But there is a silver lining for tenant advocates. A key part of the now-expired law was the exclusion of tougher local anti-eviction measures, many of which will now take effect, including in Los Angeles County.

The state is facing at least two lawsuits over the program from tenant advocates who say it has denied funding to eligible tenants and is not covering the originally promised amount of rent arrears.
More than 135,000 people — or nearly a third of all households — who applied for rent relief had been denied as of June 17, according to data obtained from the housing department through the Public Records Act. That number has risen in the past few weeks as the program has ended. The lawsuit, which cites the same data set, says tenants receive little to no explanation for their denials, making it difficult to challenge the final decision.

“Tenants are facing eviction even as their landlords get these giant checks and tenants who qualify for assistance are denied these mysterious notices that don’t tell them why. It just doesn’t make sense,” said Madeline Howard, senior counsel at the Western Center on Law & Poverty, one of the groups suing the state over the program.
Ross, of the housing department, was unable to provide specific numbers on denials, but said about half of applicants are denied because of ineligibility: they either make too much money, don’t live in a place covered by a state program, applied for a period outside program guidelines or were unable to prove their rent or the impact of the pandemic on their ability to pay rent. The other half of rejections were due to incomplete or inactive applications. It said an unspecified number of applications were fraudulent or submitted multiple times.
He said tenants with incomplete applications are told which part they need to provide additional proof, but are not limited to specific documents. He also said they were given instructions on how to contact their case managers for help.
Wicks said the latest state budget, approved this week, includes nearly $2 billion to repay the state for a line of credit opened earlier this year to pay tenants.
